Legal Department

 

The Legal Department is responsible for supporting CBJ's decisions with legal opinion and consultations, providing legal studies and researches, reviewing legislation related to CBJ and the sectors subject to its supervision and oversight, proposing the necessary amendments, and representing CBJ in courts and committees. The department particularly assumes the following tasks:

  • Maintaining, documenting, classifying and indexing all legislations, rulings, administrative decisions, legal references necessary for the work of the department, and the documents relating to the department's business.
  • Coordinating with whoever is required to hold awareness and training programs and raise awareness on issues related to the department's work.
  • Representing CBJ in negotiations of joint committees between the Kingdom and other countries.
  • Participating in the foreign delegations to cover  the legal aspects related to the mission of the delegation in relation to CBJ’s business
  • Providing legal consultation relating to administrative decisions and reviewing their legal drafting.
  • Drafting contracts and agreements in relation to CBJ’s business, or  participating in preparing / reviewing it, and providing legal consultation regarding the execution of such contracts and agreements, in addition to  ensuring that they have been well documented  and that all related  submitted  guarantees are adequate.
  • Representing the Bank in lawsuits and cases filed by CBJ or against it before local and foreign courts and arbitral tribunals pursuant to the Governor’s assignment or his deputies for any of these tasks.
  • Conducting Legal studies on comparative legislations and international best practices that regulates the business of central banks and the sectors under their supervision and oversight, and provide proposals and recommendations in this regard.
  • Reviewing draft laws, regulations, and instructions related to CBJ and the sectors subject to its supervision and oversight.
  • Reviewing the draft responses issued by CBJ related to correspondence with the House of Representatives and the Senate, in coordination with the relevant organizational units.
  • Participating in the internal committees related to the work of the department.
  • Raising performance indicators, annual work plans business reports and results.
  • Carryout risks and supervisory controls self-assessment related to the department’s function in coordination with the Risk management and compliance department per the related instructions and the adopted methodologies to determine the levels and methods of processing and managing risks.
